1. Acceptance and Age

To use this service you confirm that you are 18 years of age or older and that you accept these Terms.

2. User Representations

You warrant that the photograph is your own, that you have the right to use it, and that you will not upload images of other people (or minors) without their consent. You agree not to use the service for unlawful, defamatory, or misleading purposes.

3. Limited License

You grant us a limited and temporary license to process your photo solely for the purpose of generating your image. The original photo is deleted as soon as the image is generated; the generated image is kept while the album of the channel stays active, and you can delete it at any time from your album.

4. Intellectual Property

The app, its underlying technology, and the KysKam brand are owned by us or our licensors. You retain the rights to your original photograph.

5. Nature of the Content

The images we generate are fictional and AI-generated, for entertainment purposes only.

6. Service Provided "As Is"

The service is provided without guarantees of uninterrupted availability or specific results, to the extent permitted by applicable law.

7. Limitation of Liability

To the extent permitted by applicable law, our liability is limited to the amount paid by you for the service, and we are not liable for indirect damages. Statutory consumer protection rights remain unaffected.

8. Indemnification

You will hold us harmless from claims arising from any use of the service in breach of these Terms (for example, uploading the face of a third party without their permission).

9. Prizes

Prizes are governed by the conditions set by the corresponding partner venue and may change, vary by location, or run out.

10. Suspension

We may suspend or terminate access to the service in case of misuse or breach of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by Polish law. Disputes will be submitted to the competent courts of Poznań, Poland. Consumers retain the right to bring proceedings in the courts of their country of residence under applicable consumer-protection laws.
